Louisiana Statute of Limitations

When someone causes your injuries, and you want to file a lawsuit, you have to comply with the state’s statute of limitations. It is a strict deadline, and if you miss it, you could lose your right to sue the at-fault party for compensation. The statute of limitations for personal injury cases is one year. That means you have one year from the injury date to file suit. If you try to file after the deadline, the court will likely dismiss your case.

There are special circumstances under which you could toll, or delay, the statute of limitations:

  • The defendant left the state before you could file suit. The clock on the statute of limitations would start running upon their return, and their absence would not count towards the one-year deadline.
  • You were a minor at the time of your injury. The clock would not begin until you turn 18 years old.
  • You were mentally incompetent at the time of the accident. The clock would start once you gain mental competency.

How Modified Comparative Negligence Could Affect Your Case

Louisiana has adopted the pure comparative negligence doctrine in relation to personal injury cases. This means that if you partially contributed to your injuries, your total damages could be reduced by your percentage of shared fault. For example, let’s say you were in a car accident and incurred $100,000 in damages. If a jury determines the other driver was 75% to blame, but you were 25% to blame, you would only be entitled to a maximum of $75,000 in compensation.

Some states use a modified form of comparative negligence, which means you could be prohibited from pursuing monetary damages if you’re even 1% at fault for the incident. Others bar the collection of compensation if you’re more than 50% liable. However, Louisiana allows monetary damages even if you were 99% to blame.
