Wrongful death is for families

Although today's modern families are more likely to have both parents working, the loss of one income can still be devastating. In cases where one spouse falls victim to wrongful death, the surviving family members not only have to deal with the loss of their loved one, but also a partial loss of their livelihood.

Alcohol was factor in crash that killed pedestrian

Auto accidents happen every day. Sadly enough, many of them have alcohol as a contributing factor to the crash. Although most drunk drivers never intend on harming anyone, getting behind the wheel of a car while under the influence can be seen as intention to cause injury to others. As one Louisiana man is learning, it doesn't matter what your intentions are when you drive drunk.

Crop dusting, a dangerous business

Louisiana residents are never surprised to see small aircraft flying overhead during the warm months of summer. Crop dusting is serious business for pilots in the area, and keeping soybeans and corn fields well fertilized and free of pests is a full-time job. Just as driving a car carries risks, air travel is no different, and for crop dusters, the long hours, low altitude and high speed can make for dangerous flying.

Jones Act protects independent contractors too

For the many men and women that work on the open water, the Jones Act is a pretty familiar term. It offers protection against death or injury while working for an employer while at sea. In that respect, it mimics some of the same qualities as workers' compensation does for traditional jobs. Just as with workers' compensation, the Jones Act has a vast list of requirements and regulations for those it governs, in order to be eligible for its protection.

Strict liability in airplane accidents

Most of the time, when you hear about aviation accidents, it is assumed to be the result of either pilot error or mechanical failure.  In the case of pilot error, where negligence was found, the airline may be held responsible for the crash, accident or injury. When a defect on either the plane or a component of the plane is found to be the cause of the crash, accident or injury the manufacturer of the plane or component is held responsible.

A new perception on texting and driving

We have all heard or seen the new PSA's on texting and driving. It is dangerous, it does require your eyes and your attention to be on something other than the road, but how do you argue with teens that say they don't care. If you're the parent of a teen driver, you've probably heard their spiel on why they are not worried about it. Either they argue that they are fast when texting, or they don't stare at their phones, or they only do it at stops. Whatever their excuse is, they have conviction, and yelling at them, may not work in changing their minds or their behavior, so try science.

The entire process of an injury claim is long and frustrating, but receiving your settlement can be even more so. For some individuals, the struggle doesn't end when the case does. It ends when they are made whole by the judgment awarded to them.

Children are not quality control

Every parent knows that nothing is 100 percent child proof. With so many product recalls and safety issues out there right now parents have to be asking themselves what is safe? The truth is, we really don't know. It's not completely unheard of to have last year's most popular toy turn into this year's most urgent recall.

Death is unfair but wrongful death is just plain cruel

None of us want to say goodbye to a loved one, but when they are ripped from our lives without warning, for no reason our grief and sadness can feel insurmountable. As difficult as it is when we lose a child, spouse or friend to illness or disease there is solace found in knowing we did everything within our power to help them. However, when we experience the same loss because of someone else's negligence that solace is gone.
