The importance of an error-free accident report

If you are involved in a motor vehicle crash or other serious accident, police may be called to the scene - particularly if the accident involves any bodily injury or property damage, whether to you or to another party.

Police officers will typically fill out a standard accident report to make a record of what happened and who was involved. Sometimes police reports may be admitted as evidence in the event of a civil or criminal trial down the road.

More often, they are used by insurance companies to calculate fault, liability and damages after the accident. So what the police's accident report says could affect how much money you pay - or receive - for any damages or injuries. So if you see an error in the report it is important to do everything you can to correct it.

First, you can try calling to law enforcement official who made the report. If it is a small, straightforward error he or she may be able to correct it right away with a simple phone call.

More substantive mistakes, though, may require a written letter with some evidence of the error. An affidavit from a witness or photographic proof that contradicts the report may be helpful.

As a last resort, you may have to argue your case in court. This may only be worth the effort and cost if the report is used to justify a large penalty or your insurance refuses to pay out fairly based on the report.
