Patient sues ambulance company after accident

Ambulance drivers are supposed to help keep people safe at their most vulnerable but sometimes a rescue vehicle can become a hazard unto itself. In an ongoing Louisiana case, a wheelchair-bound man is suing an ambulance company, one of its drivers and its insurance carrier for injuries he sustained while riding in an ambulance.

The man was being transported to the hospital for an appointment when another motorist collided with the ambulance. The man was injured and his wheelchair was damaged.

According to the lawsuit, the ambulance driver failed to place a shoulder strap on him, which may have been a factor in his injuries. He has also sued the driver of the car that collided with the ambulance for failing to stop and for operating at excessive speeds, and the ambulance company for negligence in allowing an unsafe driver to operate the vehicle.

When an employee is acting as an agent of his or her employer and causes an accident, both the individual and the employer may be held liable for any damages that result. Both the driver and the company allegedly failed to fasten and secure the plaintiff and his wheelchair and failing to exercise due care.

The plaintiff is seeking damages for medical expenses, physical pain and suffering, mental anguish and emotional distress, loss of enjoyment of life and property damages. The amount has not been specified but these damages are meant to recoup some of the losses the plaintiff sustained as a result of the accident.
