1 dies, 2 injured in illegal passing accident

On June 26, about 7:30 a.m., a 34-year-old woman from Monroe, Louisiana, was killed in a two-vehicle accident on Highway 594 north of Monroe. The accident occurred, according to Louisiana State Police, when a Nissan Rogue tried to pass a Chevy Trailblazer in a no-passing zone. The Nissan clipped the Chevy when it was trying to get back in the southbound lane of the highway. This caused the driver of the Chevy to lose control. The vehicle left the roadway, hit a ditch and rolled over.

The driver of the Chevy was thrown from the vehicle and died at the scene. She was not wearing a seat belt, according to police reports. Two children between the ages of eight and 12 were also in the Chevy and suffered minor injuries. They were transported to a local hospital. The driver of the Nissan was not injured.

While impairment is not believed to be a factor in the crash, toxicology samples were collected and will be analyzed. The driver of Nissan was issued a traffic citation for passing in a no-passing zone; however, she was not arrested. State police are still investigating the car accident.

Even if no further criminal charges are filed in connection with the accident, the family of the woman who was killed could file a civil suit for wrongful death, funeral expenses, loss of consort and other damages due to the recklessness of the Nissan driver. In addition, damages could be sought for the children for their injuries for pain and suffering, medical expenses, emotional distress and other claims.
