Major league pitcher denied insurance claim
Ben McDonald, a major league baseball pitcher, sought and obtained a policy of disability insurance in the amount of $3MM. After suffering an injury that eventually led to his retirement, McDonald submitted a disability claim to the insurer. In response, the insurer denied the claim claiming McDonald failed to disclose a history of shoulder problems of recent (less than 24 months) duration to the insurer.
Result: Following numerous depositions and pretrial hearings, we secured a settlement for our client in the amount of $5MM.
